General
The website and user generated content terms and conditions and privacy policy on the www.next.three.com website apply to your use of this 3next.mobi mobile site (“site”) but with all references to “www.next.three.com” and “website” replaced with “3next.mobi” and “site”. Please see www.next.three.com for the full terms and conditions and privacy policy. The key terms and conditions are below.

You agree to these terms when you use this site. If you do not agree you must stop using the site.

We are not liable for any losses including, indirect or consequential losses resulting from, or which arises in connection with, the use of this site or other websites linked from this site.

The content on this site is provided on an "as is" basis, with no warranties.

We do not endorse: (a) the websites, products and services referred to on this site; or (b) user generated content.

We do not offer technical support for third party products or services mentioned on this site and all use is at your own risk.

Nothing in these terms removes or limits our liability which can't be limited or excluded by applicable law. Your statutory rights are not affected.

This site is governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.

User Generated Content
We invite you to post your reviews and comments on pages of this site available for users to add user generated content (the “User Generated Content Areas”). When using or submitting content to the User Generated Content Areas, you agree to be bound by the following terms and conditions.

We retain the right and discretion (but not the obligation) to edit, delete, reject or remove any submission which you or others post or seek to post in the User Generated Content Areas.

You grant us a non-exclusive, royalty-free, perpetual, worldwide licence to reproduce and deal with any of your submissions to the User Generated Content Areas by any means and in any manner whatsoever.

You must not post submissions in the User Generated Content Areas which:

• are not your original work, or which in any way violates or infringes the intellectual property rights of another person;
• encourages or advises anyone about how to break the law or infringe the intellectual property rights of another person;
• are obscene, offensive, pornographic, vulgar, profane, indecent or otherwise illegal;
• you know or suspect to be incorrect, false or deceptive;
• are defamatory of any person or company; or
• are likely to offend, insult or humiliate others.

We retain the right and discretion to terminate your access to the User Generated Content Areas if we believe you have breached these terms and conditions.

We will not be liable to you in respect of any material posted in User Generated Content Areas, nor are we responsible for its accuracy.

We will not be responsible or liable for any exercise or failure to exercise it rights under these terms and conditions.

You indemnify us against any liabilities, claims, costs, loss (including consequential loss) or damage suffered or caused by reason of your breach of these terms and conditions or your reliance on any material posted in the User Generated Content Areas.

Privacy Policy
We will only collect personal information for the following purposes, and for other purposes we agree with you:

• processing any registration made by you;
• identifying you in relation to your submission of user generated content;
• responding to and resolving any enquiries or complaints;
• providing any information requested by you;
• conducting analysis to support product development;
• contacting you for market research purposes;
• enforcing our rights under our terms and conditions; and
• keeping you up to date by post, telephone, email, and directly to your handset by text, picture, video and audio message with information about Hutchison and the 3 group of companies, 3 products and services, and offers and promotions subject to any marketing preferences indicated by you.

Your personal information may also be processed by other organisations on our behalf for the purpose for which you provided it. The use of personal data for these purposes will remain under our control at all times.

We may disclose your information to any company in the Hutchison Whampoa Limited group of companies, and to our or their partners, associates, agents or subcontractors and to possible successors to our business but only for the above purposes. Some of these parties may reside outside Hong Kong. If we do this, your information will be treated to the same standards adopted in Hong Kong. If you do not wish us to disclose your personal information as set out in this paragraph, please write by sending an email to media@three.com.

We may also disclose your information for the prevention and detection of crime and to protect the interests of Hutchison and other users or if required to do so by law.

You have the right to request a copy of any personal information we hold about you and to have any inaccuracies corrected. We may charge a reasonable administrative fee to provide a copy of any data held. Please write by sending an email to media@three.com.

We may monitor and/or record communications between you and Hutchison for quality control and training purposes.

The site is owned and operated by Hutchison Whampoa Limited.
